Terms of Service — FEATUP

1. Purpose and role of FEATUP

FEATUP is a mobile application for connecting people who want to practise a sporting activity together: partner search, sports events, recurring groups, coaches and verified professionals. By creating an account, you accept these terms.

FEATUP is exclusively a technical intermediary and hosting platform within the meaning of applicable law. FEATUP:

Any reference in the application to a "FEATUP event", a "verified pro" or a "secure payment" refers solely to technical features of the platform and creates no organisational, warranty or performance obligation on the publisher.

2. Eligibility

Use of FEATUP is restricted to natural persons aged 16 or over. One account per person. Payment features and the organisation of paid events may be subject to additional conditions (in particular legal majority and validation by the payment provider, section 11).

3. Account

You are responsible for keeping your credentials confidential and for the accuracy of your profile information. Accounts using a false identity, impersonating a third party or containing misleading information (in particular about age) may be suspended or deleted.

5. User content and prior moderation

You remain the owner of the content you publish (photos, biography, messages, events). You grant the publisher a non-exclusive, worldwide, free licence, limited to hosting and displaying this content in the application, for the duration it is online. You remain solely responsible for the content you publish.

Prior moderation of public posts: every public post (photo and caption) is analysed by automated systems before going live, in accordance with the Privacy Policy (section 4). Content judged safe is published immediately; content flagged by the analysis is held and submitted to a human moderator, who alone decides to publish or reject it — no rejection decision is fully automated. This moderation serves exclusively the safety of the community; it constitutes neither general editorial control nor a guarantee of the lawfulness of published content, for which each author remains solely responsible. You may contest any decision via contact@featup.app.

6. Moderation and reporting

Any user may report a profile, content, conversation or event (including a paid event that did not take place, section 12). The publisher may remove content, freeze funds pending verification, suspend or delete an account in case of violation of these terms, with immediate effect in case of serious violation (safety, minors, harassment, fraud). Moderation — prior (section 5) as well as upon report — is carried out in good faith; it constitutes neither a general monitoring obligation nor a guarantee.

FEATUP is built on trust between members. By using the application, you accept that:

Any manipulation of the reliability system (false attendance confirmations, complacency or retaliation assessments, multiple accounts, fictitious sessions) constitutes a serious breach of these terms, which may lead to immediate suspension or deletion of the account and the reset of the affected indicators.

8. Meetups, sporting activities and safety

FEATUP connects users but does not organise meetups and performs no background checks (criminal record, solvency, behaviour).

Sporting activity involves inherent risks (injuries, accidents, material damage), which each user assumes personally and in full knowledge. By taking part in a meetup, group session or event found via FEATUP, you confirm that:

9. Events and groups: exclusive role and responsibility of the organizer

Any event or recurring group (free or paid) is created, defined and run under the sole and entire responsibility of its organizer, whether an individual or a professional. The organizer is solely responsible for, without limitation:

The contract relating to participation in an event is formed exclusively between the organizer and the participant. FEATUP is not a party to that contract, does not act on behalf of the organizer and guarantees neither that the event will take place, nor its quality, nor its conformity with its description.

10. Professional accounts: documentary verification only

The "PRO" badge indicates only that the user has submitted an identity document, a verification selfie and one to three diplomas or certifications, and that these documents have undergone a manual documentary review by the publisher.

This verification is limited to the apparent consistency of the submitted documents. It constitutes neither a certification nor a guarantee:

Professionals use FEATUP as independent contractors. No employment, mandate, franchise, agency or partnership relationship is created with the publisher. The decision to use a professional's services rests solely with the user, who is responsible for carrying out their own checks.

11. Paid events and payments

This feature is not active to date. The provisions of this section and of section 12 apply only when this feature is active in the application; they are without object as long as it is not.

Payments for paid events are processed by Stripe (Stripe Payments Europe, Ltd. and affiliated companies), an authorised payment service provider, under its own terms, which the organizer and the participant accept by using the feature. Funds are held by Stripe, never by the publisher. FEATUP acts as a technical matchmaking intermediary and charges a service fee of 20% of the event price, deducted from the amount paid out to the organizer.

Escrow: the amount paid by the participant is held until the event has taken place, then paid out to the organizer (minus the service fee) at the earliest 24 hours after the start of the event.

Withdrawal and refund:

Organizers: receiving payments requires opening a Stripe Connect account and passing Stripe's checks (identity, anti-money-laundering). The publisher is not responsible for a refusal, suspension or delay attributable to Stripe.

Payment disputes: any dispute relating to an event (quality, conformity, conduct) is a matter between the organizer and the participant. The publisher may, without being obliged to, freeze funds upon report and carry out good-faith checks; it assumes no obligation of arbitration, guarantee or refund from its own funds.

12. Reporting an event that did not take place

When the paid events feature is active: if a paid event did not take place, any registered participant may report it in the application after the scheduled start time. The payout to the organizer is then frozen pending verification by the publisher. Depending on the outcome, the funds are either paid out to the organizer or refunded to the participants. Abusive or fraudulent reports constitute a violation of these terms and may lead to account suspension.

13. Availability and limitation of liability

The service is provided "as is" and "as available". The publisher does not guarantee the continuous availability of the application, the absence of errors, or the accuracy of information published by users and organizers.

To the fullest extent permitted by applicable law, the publisher's liability is excluded for:

The publisher's mandatory liability for gross negligence or wilful misconduct (art. 100 CO) remains reserved, as does any liability that cannot be excluded under applicable law. Where the publisher's liability cannot be excluded, it is limited, to the extent permitted, to the amount of the service fees actually received by the publisher for the event concerned.

14. Indemnification

You undertake to indemnify and hold the publisher harmless from any third-party claim, action or demand (including reasonable defence costs) resulting from your violation of these terms, the content you publish, the events you organise or your practice of an activity via the platform, except in case of the publisher's own fault.

15. Intellectual property

The FEATUP trademark, logo, application and its own content are protected. Any unauthorised reproduction is prohibited.

16. Personal data

The processing of personal data — including identity documents, the verification selfie (biometric data), community reliability data, moderation data and payment data — is described in the Privacy Policy, which forms an integral part of these terms.

17. Termination

You may delete your account at any time (Settings → Delete my account); your data is then erased in accordance with the Privacy Policy. Deleting the account does not release you from obligations arising beforehand (in particular ongoing paid events, funds in escrow, indemnification obligations). The publisher may terminate the contract in case of violation of these terms.

18. Changes

The publisher may amend these terms. Substantial changes will be notified in the application at least 30 days before they take effect; continued use constitutes acceptance.

19. Severability and entire agreement

If a clause of these terms is declared void or unenforceable, the other clauses remain in force; the invalid clause is replaced by a valid, economically equivalent clause. These terms and the Privacy Policy constitute the entire agreement between you and the publisher.

20. Governing law and jurisdiction

These terms are governed by Swiss law, excluding conflict-of-law rules and the Vienna Convention. The place of jurisdiction is Geneva, subject to mandatory venues provided by law (in particular for consumers).
